Planning and Development Amendment Bill 2023 - Draft LPS Amendment Regulations No.2 Consultation

Overview

The Planning and Development Amendment Bill 2023 (Bill) facilitates the delivery of the government’s priority planning reforms. The Bill, which proposes various changes to the Planning and Development Act 2005 (Act) to modernise and streamline the planning system and assist with the efficient delivery of housing and other critical infrastructure.

A number of reforms are proposed through the Bill, including the following:

• Changes to the role and responsibility of local governments in decision making on development applications for single houses. 
• Creating a permanent pathway for significant development assessment. 
• Streamlined processes for preparing, amending and rescinding State Planning Policies and Planning Codes. 
• Reforms of the Western Australian Planning Commission (WAPC).

To support the changes to the Act, various new regulations, regulation amendments and guidance documents have been developed. This includes: 

• The Draft Planning and Development (Local Planning Scheme) Amendment Regulations 2023 (No.2) (Draft LPS Amendment Regulations No.2) – prepared to support the streamlined implementation of the new regulations relating to State Planning Policies and Planning Codes. 
   
• The Draft Planning and Development (Local Planning Scheme) Amendment Regulations 2023 (No.3) (Draft LPS Amendment Regulations No.3) – prepared to outline processes associated with the changes associated with local governments role and responsibilities in decision making on single house proposals.
   
• The draft Significant Development Pathway Guide for Applicants (Draft Applicants Guide) – prepared to outline processes associated with the permanent development assessment pathway for significant developments, and supplement those processes outlined in the draft Planning and Development (Significant Development) Regulations.
