Overview

Consultation is open on both the draft Sorrento Precinct Structure Plan and Development Application.

The purpose of the draft Sorrento Precinct Structure Plan is to replace the existing Sorrento Activity Centre Plan to facilitate the future redevelopment of the Structure Plan area for a mix of commercial and residential purposes. 
The Development Application includes 75 Apartments, a Restaurant, Café and Liquor Store (Small).

The Department of Planning, Lands and Heritage and the City of Joondalup are undertaking joint consultation on both the draft Sorrento Precinct Structure Plan and the Development Application to streamline the process and avoid unnecessary duplication.

Why is a Precinct Structure Plan proposed?
Since the Sorrento Activity Centre Plan was approved by the Western Australian Planning Commission (WAPC) in 2017, activity centre plans have been replaced by a new instrument, Precinct Structure Plans. Precinct Structure Plans are guided by State Planning Policy 7.2 – Precinct Design (SPP7.2) and associated guidelines and inform the land uses and overall development (including built form) that can occur within an activity centre.

In line with SPP7.2, the applicant has prepared a draft Sorrento Precinct Structure Plan to replace the Sorrento Activity Centre Plan. The Sorrento Precinct Structure Plan will provide the framework to support redevelopment of the existing centre for a mix of commercial and residential purposes.

Who has prepared and submitted the draft Sorrento Precinct Structure Plan for consideration?

The draft Sorrento Precinct Structure Plan has been prepared by Planning Solutions on behalf of WCD Pty Ltd. The City of Joondalup is required to assess the plan following public advertising and make a recommendation to the WAPC.

What are the main changes between the Sorrento Activity Centre Plan and the draft Sorrento Precinct Structure Plan?

The main changes proposed to the current Sorrento Activity Centre Plan are:

  • Including Lot 145 (2) Drakes Walk, Sorrento within the precinct plan boundary
  • Amending the density from R80 to R-AC3 and the dwelling target from 77 to 75 dwellings
  • Increasing the maximum height from five storeys to six storeys with an option for an additional two storeys where there is a demonstrated community benefit
  • Modifying the built form requirements
  • Updating references to reflect the Residential Design Codes Volume 2 - Apartments
  • Aligning the format with SPP7.2 and providing additional co-consultant inputs in support of the changes as proposed.

Why does the draft Precinct Structure Plan propose additional height subject to community benefit?

The SPP7.2 guidelines allow for development incentives (such as height) to be considered in exchange for tangible community benefits. Community benefit is the public good a proposal delivers, such as public realm infrastructure improvements or improved sustainability outcomes. The maximum building height or community benefits proposed within the draft Sorrento Precinct Structure Plan have not yet been assessed by the City.

What does this mean for the existing Sorrento Activity Centre Plan?

Should the draft Sorrento Precinct Structure Plan be approved by the WAPC, the existing Sorrento Activity Centre Plan will be revoked under the Planning and Development (Local Planning Schemes) Regulations 2015.

Why has a Development Application been submitted to the WAPC for this site?

Planning Solutions on behalf of WCD Pty Ltd has lodged an Application for Development Approval (the ‘Development Application’) for an eight (8) storey mixed use development that is consistent with the draft Sorrento Precinct Structure Plan with the Department of Planning, Lands and Heritage. The Development Application has been lodged under Part 17 of the Planning and Development Act 2005 (PD Act), which has established the WAPC as the decision-making authority for significant development applications to support the State’s economic recovery from the COVID-19 pandemic. The City of Joondalup’s role in the process for the Development Application is as a referral agency only. This means that the City will prepare a report to Council on the Development Application and Council will then provide comments to the WAPC. 

Why is the consultation on the draft Sorrento Precinct Structure Plan and Development Application being undertaken concurrently?

The advertising of both the draft Sorrento Precinct Structure Plan and the Development Application is being undertaken concurrently by the City of Joondalup and the Department of Planning, Lands and Heritage to streamline the process and avoid unnecessary duplication. As the draft Sorrento Precinct Structure Plan and the Development Application are generally aligned, advertising the more detailed Development Application will assist in visualising the proposed built form outcomes which are not ordinarily contained in a Precinct Structure Plan. It also provides a single location to view plans, make a submission and get more information on either the draft Sorrento Precinct Structure Plan or the Development Application.

Can I make a submission on both the draft Sorrento Precinct Structure Plan and the Development Application?

Yes, you can make a submission on the draft Precinct Structure Plan, the Development Application, or both. The City and the Department are running public advertising through the Department’s online Consultation Hub to simplify the dual consultation process. Using the online form will ensure submissions are received and are valid. You do not have to create an account to make an online submission, you can add attachments and your submission is confidential.

Will my submission or personal details be provided to the City of Joondalup?

All submissions received on both the draft Sorrento Precinct Structure Plan and the Development Application will be provided in full to the City of Joondalup.

Will my submission or personal details be released to the public?

No. A schedule of the submissions received will be reported to the City of Joondalup Council, however individual names and addresses will not be published. For the Development Application, the key matters arising from public consultation will be summarised in the report to the WAPC. A separate schedule will be provided to WAPC Commissioners.

How is the draft Sorrento Precinct Structure Plan assessed and who makes a decision on whether it is endorsed?

The draft Sorrento Precinct Structure Plan is required to be advertised for public comment in accordance with the requirements of the Planning and Development (Local Planning Scheme) Regulations 2015. The proposal is yet to be assessed, and the advertising of the proposal does not indicate support or otherwise for the draft Sorrento Precinct Structure Plan.

After advertising closes, the City will consider all submissions received on the draft Sorrento Precinct Structure Plan and prepare a report for Council on the outcomes of consultation as well as an assessment of the draft Sorrento Precinct Structure Plan in accordance with SPP7.2. The Council meeting where the draft Sorrento Precinct Structure Plan is considered will be open to the public and anyone who makes a submission on either the draft Sorrento Precinct Plan or the Development Application will be invited to attend. 

Council will then make a recommendation to the WAPC, and the WAPC will make the final decision to either support the draft Sorrento Precinct Structure Plan with or without modification, or to not support the plan. 

How is the Development Application assessed and who makes a decision on whether it will be approved?

The Department of Planning, Lands and Heritage will prepare a report for the WAPC on the outcomes of consultation and an assessment of the Development Application. This assessment will consider matters such as design quality, building height and density, parking and traffic impacts, landscaping and public benefits. The report will either recommend that the application be approved with conditions or that it be refused.  

A meeting for the WAPC to determine the Development Application will then be scheduled. Once a meeting date is confirmed, any person who made a submission on either the draft Sorrento Precinct Structure Plan or the Development Application will be advised and can attend the meeting in person or virtually via Zoom. They can also apply to make a presentation (deputation) to the WAPC. There are no timeframes for the WAPC to determine an application.

Can the WAPC make a decision on the Development Application prior to the draft Precinct Structure Plan being endorsed?

While consultation for the draft Sorrento Precinct Structure Plan and the Development Application is occurring concurrently, there is no statutory timeframe for the determination of the Development Application under the Part 17 significant development assessment pathway. Currently there is no timeline for the determination of the Development Application by the WAPC. 

In making any decision on the Development Application, the draft Sorrento Precinct Structure Plan would still be a relevant consideration regardless of whether it has been endorsed.
